Reasons Why Your Divorce Might Be Delayed

California is no-fault divorce state, but paperwork must be completed in order for the judge to grant you a divorce in Pasadena. If you have an attorney, he or she will complete the paperwork on your behalf. If you're representing yourself, you'll be responsible for handling all of the paperwork.

The court will likely reject your judgment papers and delay the completion of your divorce if:

  • The Judgment includes property, debts, or other issues that weren't mentioned in the Petition or Property Declaration.
  • Your property settlement agreement appears to be one sided or unfair. The court will not approve a settlement that is obviously in favor of one spouse at the expense of the other.
  • If you have children, your papers don't provide enough detail about your parenting plan to calculate child support orders. Your parenting plan is relevant because the amount of time each parent will be spending with the children is a factor in determining child support payments. Support orders aren't calculated on income alone.
  • There is no proof of service for Summons and the Petition.

As you can see, there are a lot of details to keep track of during your divorce proceedings. If you want to make sure that your divorce is completed as quickly as possible, with no delays caused by missing or incomplete paperwork, hiring a divorce attorney is a smart move.

An attorney can also help to make sure that the settlement terms are in your best interests. If you did not work outside the home during your marriage or if you allowed your partner to handle all of the marital finances, having an outside party to advocate for your needs is essential. Do not allow the balance of power to be tipped in favor of your ex.
